Terms of Use

1. Acceptance of Terms

By accessing or using the Boatify Rentals platform, you agree to be bound by these Terms of Use (“Terms”). If you do not agree with any part of these Terms, you must not use our services.

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding contract to use our platform. By creating an account, you affirm that you meet these requirements.

3. Account Registration

To access certain features of the platform, you must register for an account. You agree to provide accurate and complete information during the registration process and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Listing and Booking Obligations

Boat Owners: You are responsible for ensuring that your listing is accurate, including boat details, availability, pricing, and compliance with all applicable laws and regulations. Misrepresentation of your listing may result in penalties, including account suspension or termination.

Renters: By booking a boat, you agree to the terms specified in the listing, including payment, cancellation policies, and any additional requirements set forth by the boat owner.

5. Payments and Fees

All payments are processed securely through our platform. As a renter, you agree to pay all applicable fees, including service fees, taxes, and any other charges related to the booking. Payment is due upon booking confirmation. As a boat owner, you agree that Boatify Rentals may withhold applicable service fees from the payment processed for your booking.

6. Cancellations and Refunds

Boat Owners: If you need to cancel a booking, you must do so in accordance with the platform’s cancellation policy. Repeated cancellations may result in penalties or account suspension.

Renters: Cancellations must be made according to the cancellation policy outlined in the listing. Depending on the timing of your cancellation, you may be eligible for a full or partial refund, minus any non-refundable fees.

7. RELEASE AND INDEMNITY

IN THE EVENT OF A DISPUTE BETWEEN A RENTER AND AN OWNER, BOTH PARTIES, JOINTLY AND SEVERALLY, AGREE TO INDEMNIFY, RELEASE, DEFEND, AND HOLD HARMLESS BOATIFY RENTALS AND ITS DIRECTORS, OFFICERS, AGENTS, AND EMPLOYEES (COLLECTIVELY, THE “BOATIFY RENTALS PARTIES”) FROM ANY CLAIMS, CAUSES OF ACTION, DEMANDS, RECOVERIES, LOSSES, DAMAGES (ACTUAL AND CONSEQUENTIAL), FINES, PENALTIES, AND OTHER COSTS OR EXPENSES, OF ANY KIND OR NATURE, INCLUDING BUT NOT LIMITED TO REASONABLE LEGAL AND ACCOUNTING FEES (COLLECTIVELY, THE “CLAIMS”), KNOWN AND UNKNOWN, ARISING OUT OF OR IN ANY WAY CONNECTED WITH SUCH DISPUTES. THIS INCLUDES, WITHOUT LIMITATION, DISPUTES ARISING OVER BREACH OF THIS AGREEMENT, BREACH OF ANY SEPARATE AGREEMENT OR TRANSACTION, AND/OR THE SUBSTITUTION OF RENTAL UNITS.

FURTHER, BOTH RENTER AND OWNER EACH HEREBY AGREE TO INDEMNIFY, RELEASE, DEFEND, AND HOLD HARMLESS THE BOATIFY RENTALS PARTIES FROM ANY CLAIMS BROUGHT AS A RESULT OF:

1. BREACH OF THE TERMS: ANY BREACH OF THESE TERMS AND CONDITIONS BY EITHER PARTY.
2. VIOLATION OF LAW OR THIRD-PARTY RIGHTS: ANY VIOLATION OF ANY LAW OR THE RIGHTS OF A THIRD PARTY.
3. USE OF THE SERVICES: ANY ISSUES ARISING FROM THE USE OF BOATIFY RENTALS’ SERVICES, INCLUDING BUT NOT LIMITED TO THE RENTAL, OPERATION, OR USAGE OF BOATS OR OTHER WATERCRAFT.

8. Insurance and Liability

Boat Owners: You are responsible for ensuring that your boat is adequately insured. Boatify Rentals may offer or facilitate access to insurance, but it is your responsibility to ensure the coverage meets your needs.

Renters: You are encouraged to confirm whether insurance is included in your rental. Boatify Rentals is not liable for any damages, injuries, or losses that occur during the rental period.

9. User Conduct

All users agree to conduct themselves responsibly and ethically while using the platform. Prohibited activities include, but are not limited to, fraudulent behavior, harassment, and violation of intellectual property rights. Any breach of these terms may result in immediate suspension or termination of your account.

10. Dispute Resolution

Any disputes arising from these Terms or the use of the platform will be resolved through binding arbitration in accordance with the rules. The decision of the arbitrator will be final and binding on all parties.

11. Termination

Boatify Rentals reserves the right to suspend or terminate your account or access to the platform at its sole discretion, without prior notice, for any reason, including but not limited to a violation of these Terms. You may terminate your account at any time by contacting customer support.

12. Modifications to Terms

Boatify Rentals may modify these Terms at any time. When changes are made, the revised Terms will be posted on the platform, and the “Last Updated” date will be updated. Continued use of the platform after any changes have been made constitutes your acceptance of the new Terms.

13. Governing Law

These Terms are governed by the laws of the State of Texas, specifically those applicable in Austin, without regard to its conflict of laws principles. Any legal action or proceeding related to your use of the platform must be brought in the appropriate court located in Austin, Texas.

14. Limitation of Liability

To the maximum extent permitted by law, Boatify Rentals and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the platform; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; and (iii) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our platform by any third party.

15. Indemnification

You agree to indemnify, defend, and hold harmless Boatify Rentals, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with (i) your access to or use of the platform; (ii) your violation of these Terms; or (iii) your infringement of any third-party rights, including without limitation any intellectual property rights.

16. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision will be struck and the remaining provisions will remain in full force and effect.
